We are dealing with a similar situation also. We went to the city planning committee first before signing any lease. Just told the realtor that the place would work perfect, but won't move forward till the city approves it.

You simply return the bank's money should you not need it for the lease and can mention being approved before you take the funds to.

Even though you have all your ducks in a row and codes accounted for....City counsel can still reject it by a vote. They may not want you in thier city. There are all kinds of reasons other then codes for not approving the attraction....
