  • Music Videos?

    I've been seeing a few of the bigger haunts doing "cover" videos of popular songs. Dent Schoolhouse just did one and it was great! Is there a way they're skirting the whole copyrighted music thing or are they taking the chance that You Tube may yank it for copyright violation? We were wanting to do something similar last year, but I was worried about getting hit with a violation. Anyone else try this with success?

    I think with YT, it's a case-by-case thing, and whether someone with a well paid lawyer is complaining or not. After all, there is a huge glut of fan vids on YT of this, that, and the other featuring some copyrighted song. It would be cost prohibitive to police all of it.

    As far as cover tunes, well, if you are paid up with your ASCAP dues, usually you have some wiggle room . . . assuming that YT bothers with ASCAP.

        Maybe try catching up with a local band, you'd be surprised what they are willing to come up with for you. We got a few sweet songs from T.H.O.R.N. Web Designs

          Careful with YouTube

          I just looked into this through an entertainment lawyer, because I am going to be adding these to my haunt this year. YouTube content is copyright protected, and its not the band you need to worry about but ASCAP and BMI. My wife runs a nightclub, and they tried once to get around ASCAP and BMI. They were successful for awhile, but when they caught up to them it costs +$40,000 in fines and penalties!

          Another friend of mine owns a campground. They have DJs and an occassional band. They were not paying ASCAP/BMI. Then they advertised a Buffett Themed weekend. They werent planning on music, just using the theme. They are now paying ASCAP/BMI annually.

          Some bands will grant you permission to use their videos (I have a few of these in my files) but make sure it is in writing. ASCAP and BMI will argue you are providing entertainment for a fee (selling tickets to an event) and using copyrighted music. They will still want their cut even if you have the permission. I am paying ASCAP and BMI (its not much) to save myself from the hassles.

            I've posted a vid with a simple SNIPPET of music on youtube and the video was yanked for copyright terms violations...but I've noticed as long as you put a simple disclaimer stating you don't own the rights to the music yada yada yada then YT doesn't really bother snagging your video.
